1. Definitions

• "Platform" refers to the MyHolidayTrip website (myholidaytrip.in) and mobile applications
• "Company", "We", "Us" refers to Vihana Tours & Travels Pvt Ltd
• "User", "You" refers to any person accessing or using the Platform
• "Hotel Partner" refers to accommodation providers listed on the Platform
• "Booking" refers to a confirmed reservation made through the Platform
• "Services" refers to hotel booking, payment processing, and related services provided through the Platform

2. Eligibility

• You must be at least 18 years of age to use this Platform
• You must have the legal capacity to enter into binding contracts
• By using the Platform, you represent that you meet these eligibility requirements
• We reserve the right to refuse service or terminate accounts at our discretion

3. Account Registration

• You may register using your phone number or email with OTP verification
• You are responsible for maintaining the confidentiality of your account credentials
• All activities under your account are your responsibility
• Notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Bookings & Reservations

4.1 Booking Process

• A booking is confirmed only upon successful payment and receipt of a confirmation voucher
• Room availability and pricing are subject to real-time updates and may change without notice
• We act as an intermediary between you and the Hotel Partner — the contract for accommodation is directly between you and the hotel

4.2 Pricing & Taxes

• All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise
• GST is charged as per government regulations (5% for tariffs up to ₹7,500/night, 18% above ₹7,500/night)
• Additional charges (extra bed, meals, amenities) may apply at the hotel — these will be disclosed before booking
• Promotional pricing and coupon discounts are subject to specific terms and expiry dates

4.3 Check-in & Check-out

• Standard check-in time is 12:00 PM to 2:00 PM (varies by hotel)
• Standard check-out time is 10:00 AM to 11:00 AM (varies by hotel)
• Early check-in and late check-out are subject to availability and may incur additional charges
• Valid government-issued photo ID is required at check-in

5. Payments

• Payments are processed securely through Razorpay (PCI-DSS compliant)
• We accept credit cards, debit cards, UPI, net banking, and digital wallets
• Full payment is required at the time of booking unless "Pay at Hotel" is offered
• In case of payment failure, your booking will not be confirmed
• Any disputes regarding payment should be raised within 30 days of the transaction

6. Cancellation & Modifications

• Cancellation policies vary by hotel and are clearly displayed during booking
• Free cancellation (where applicable) must be done before the specified deadline
• Cancellation after the deadline may attract partial or full charges as per the hotel's policy
• No-shows may be charged the full booking amount
• Modification requests are subject to availability and may involve price adjustments
• Refunds for eligible cancellations are processed within 5-10 business days

7. User Responsibilities

By using our Platform, you agree to:

• Provide accurate and truthful information during registration and booking
• Comply with hotel rules and policies during your stay
• Not use the Platform for any illegal, fraudulent, or unauthorized purpose
• Not attempt to interfere with the Platform's functionality or security
• Not create multiple accounts for fraudulent purposes
• Respect the property and staff at hotels during your stay

8. Intellectual Property

All content on the Platform — including text, graphics, logos, images, software, and trademarks — is the property of Vihana Tours & Travels Pvt Ltd or its licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

9. Reviews & User Content

• Reviews must be genuine, based on actual stays, and free from abusive or defamatory content
• We reserve the right to moderate, edit, or remove reviews that violate our guidelines
• By posting a review, you grant us a non-exclusive, royalty-free license to use and display it
• We are not responsible for opinions expressed in user reviews

10. Limitation of Liability

• We act as an intermediary and are not liable for the quality of accommodation or services provided by Hotel Partners
• We are not responsible for any loss, damage, or injury during your stay at a hotel
• Our total liability shall not exceed the amount paid by you for the specific booking in question
• We are not liable for force majeure events (natural disasters, pandemics, government actions, etc.)
• We do not guarantee uninterrupted or error-free access to the Platform

11. Indemnification

You agree to indemnify and hold harmless Vihana Tours & Travels Pvt Ltd, its officers, directors, employees, and partners from any claims, losses, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Dispute Resolution

• Any disputes shall first be attempted to resolve through mutual discussion and mediation
• Unresolved disputes shall be subject to the exclusive jurisdiction of courts in Vapi, Gujarat, India
• These Terms are governed by the laws of India

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
